I’m Simran Bhatt, currently preparing for my CA Final exams, and this query arose during my articleship fieldwork. We have a client, an individual, who operates a small online consulting business (professional services, eligible for 44ADA) and also runs an e-commerce platform selling niche products (business, potentially eligible for 44AD). Their turnover for the e-commerce part is just under ₹2 crore, and professional receipts are around ₹40 lakhs. The challenge is that their actual profit from the e-commerce business is significantly lower than 8% due to high inventory costs and returns, but for the professional services, actual profit is higher than 50%. If they opt for presumptive taxation under 44ADA, must they also necessarily opt for 44AD, even if it means declaring higher profits than actual for the e-commerce part, or undergo a full tax audit if they declare lower? Section 44AE isn’t applicable. My understanding from the ICAI study material is that opting out of 44AD/ADA mandates an audit under 44AB if profits are below the presumptive rate, but I’m unsure about the interplay when both sections could apply concurrently and one business segment doesn’t meet the presumptive profit criteria economically. What’s the optimal, compliant approach here to avoid an audit while legally declaring actual profits?
