I’m really grappling with the recent insertion of clause (h) in Section 43B of the Income Tax Act, which mandates disallowance for delayed payments to MSMEs. As a CA Final student currently in my articleship, I’m finding a disconnect between the bare text, our ICAI study material, and practical implications. Specifically, the MSMED Act’s definition of ‘micro’ and ‘small’ enterprises, along with the ‘date of acceptance’ or ‘date of deemed acceptance’ for goods/services, seems incredibly nuanced.

My challenge is twofold: First, how are firms practically verifying the MSME status of every vendor, especially for recurring small-value transactions, to avoid future disallowances during assessments? Many vendors aren’t readily providing Udyam registration numbers. Second, for exam purposes, should we assume meticulous compliance and clear understanding of the ‘appointed day’ as per MSMED Act for every scenario, or is the ICAI’s expectation aligned with a more generalized approach given the practical difficulties? This section feels like it could be a major practical headache during audits and for exam questions.
