I’m facing a very specific challenge regarding the practical application of the newly inserted Section 43B(h) of the Income Tax Act concerning payments to MSMEs. As a CA Final student currently in my third year of articleship, I’ve been encountering this frequently in audit engagements. While the ICAI study material covers the theoretical aspects and the MSMED Act’s provisions regarding payment timelines (15/45 days), the real-world scenarios are far more complex.
Specifically, how are firms effectively managing the identification of MSMEs from vendor lists, verifying their Udyam registration, and tracking payment due dates, especially for large client bases with hundreds of vendors? My concern is the significant disallowance risk under the Income Tax Act if a payment is delayed even by a day. Are there any specific best practices, software tools, or interpretations from appellate authorities that senior practitioners are relying on to navigate this, especially when the client’s internal accounting systems aren’t fully geared for this level of vendor classification and payment tracking? It feels like a minefield for both clients and auditors.
